The Supreme Court fined the man Rs 500,000 for filing a baseless case against his ex-wife.
ISLAMABAD – The Supreme Court of Pakistan has fined a man Rs 500,000 for initiating baseless legal proceedings against his ex-wife after she was evicted.
In its detailed nine-page judgment, the court held that dragging a woman into unnecessary legal proceedings after obtaining Khula is a grave violation of her dignity, self-respect and freedom. The court ordered the ex-wife to pay the penalty within 30 days, warning that failure to do so would allow recovery through the concerned family court.
The case involved allegations made by an ex-husband accusing his ex-wife of misconduct in an attempt to damage her reputation. The court observed that such measures are aimed at coercion and are an abuse of judicial process. It further emphasized that legal action should not be used as a tool of harassment or humiliation.
The Supreme Court also affirmed that after completion of Khula and Idda, a woman has full right to remarry without seeking permission from her ex-spouse. He urged the courts across the country to be vigilant against misuse of matrimonial laws.
The judgment said that preventing malicious litigation is a key responsibility of the judiciary as well as protecting the dignity of litigation. The court dismissed the ex-husband’s appeal against the earlier judgment of the Peshawar High Court.
According to the details of the case, the family court in Peshawar had issued the khula in 2014 after the woman renounced her dowry, citing abuse, eviction and separation from her minor daughter, who was later handed over to her mother.
After the divorce and completion of Idah, the woman remarried, after which the ex-husband initiated further legal proceedings claiming that he was still legally married to her. His petition was rejected at several court levels before reaching the Supreme Court.
